Terms of Service

This calculator will give you an indication of the CIL charge payable on a chargeable development, given the parameters you supply. The calculator is based on the formula set out in Schedule 1 of the CIL Regulations 2010 (as amended), and the CIL rates set by the council.

It is not intended as a final representation of your total liability, and does not constitute legal advice. You should not rely on the calculator when making decisions which depend on the CIL charge amount. Formal determination of the CIL liability will be made by the Council when a Liability Notice is issued after a CIL liable application is approved or following the or submission of a valid CIL Form 5.

Paying CIL in Instalments
Waverley Borough Council has an approved CIL Instalment Policy in place and CIL charges will be payable in accordance with this policy, where the requirements of the CIL Regulations (2010) are followed. Where applicable, the payment of CIL by instalment should be taken into account in any viability assessments, as this will assist with cash flow.

Phased Development
In cases where a development which is specifically permitted as being phased for CIL purposes, each phase is treated as separate development for the purposes of CIL, and each phase should be entered into a separate calculator. The phasing of payments should be taken into account in any viability assessments, as this will assist with cash flow.

Relief and Exemption from CIL
The Council do not automatically apply any relief or exemption and you must make an application using the relevant forms and by submitting supporting information and/or evidence. In all cases there are particular criteria to be met for a relief or exemption to be granted. Final CIL Liability
Formal determination of the CIL liability will be made by Waverley Borough Council, when a Liability Notice is issued following the approval of a CIL liable application or following the submission of a valid CIL Form 5. Please note that the CIL charges produced by the calculator are only indicative, and may differ to the final calculation of CIL liability.

The final calculation of the CIL chargeable amount will be based on the final gross internal area (GIA) floorspace figures proposed as part of the approved development, and will depend on the following:
- Is the floorspace of existing buildings to be demolished or retained eligible for deduction from the CIL chargeable amount?
- Is the development eligible for relief or exemption from CIL?
- Has indexation been applied?
- Have any surcharges or late payment interest been applied?
