Mid Sussex District Council secures planning obligations in consultation with other infrastructure providers, including West Sussex County Council.
As Mid Sussex District Council is party to all Section 106 agreements all monies secured as a result of a planning permission will be detailed in this report. However, with regard to contributions received, allocated and spent, the report relates exclusively to funds under the responsibility of Mid Sussex District Council.

Definitions
Through this report there are references to the following terms:-
· Potential: A contribution that has been agreed/secured within a signed legal document. These contributions have not been collected and if the planning application is not implemented they will never be received and the associated projects may not be delivered alongside the development in question.
· Due: A contribution that has been requested to be paid as the trigger point within the signed legal document has been reached. Each contribution within section 106 agreements is subject to its own trigger (usually determined by the construction or occupation of a number of units). This sum will in most cases be subject to indexation and therefore will differ to the amount secured (potential amount).
· Collected: A contribution has been paid in line with the signed legal document.
· Allocated: A monetary contribution has been received and funds have been allocated to a specific project(s) in line with the legal agreement. Where legal agreements have specified the use of contributions between several projects within the obligation the amount allocated has been split accordingly. The collection of funds and the subsequent delivery of infrastructure may not occur for a number of years after the funds have been allocated due to the nature/scale of the project.
· Spent: A contribution has been transferred to the project(s) applicant following the production of invoices. Prior to the spend the project has been agreed it is appropriate use of s106 funding and the necessary report for a robust audit trail has been written, agreed and signed off prior to the commencement of the project.
· Available: As all signed legal documents are signed project specific this column reflects all monies are allocated on receipt of funds.
