Terms of Service

This calculator will give you an indication of the CIL charge payable on a chargeable development, given the parameters you supply. The calculator is based on the formula set out in Regulation 40 and Schedule 1 of the CIL Regulations 2010 (as amended, 2019), and the CIL rates set by Enfield Council.

In order to ensure that the CIL measurement is accurate, please provide the relevant CIL form 1 with marked up floorplans for both existing and proposed use, as well as confirming the last use of existing.  If this information is not provided during the planning application validation stage, then there could be a delay or difference in calculations, which may delay your development.   Likewise you also need to provide the CIL forms 2 and 6 and any other applicable CIL forms as soon as you receive the Liability Notice in order for the CIL case to be progressed further to reduce risks of delays and financial penalties.   

It is not intended as a final representation of your total liability, and does not constitute legal advice. You should not rely on the calculator when making decisions which depend on the CIL chargeable amount. Formal determination of the CIL liability will be made by Enfield Council when a Liability Notice is issued after a planning permission is granted.

Indexation
If you add a decision date, it will automatically add indexation based on our records, but if you leave the decision date blank it will exclude indexation.  

Outline and Reserved Matters
For Reserved Matters decisions use the decision date of the outline permission to show correct indexation to apply.

Section 73
This calculator does not cover S73 calculations which requires a different calculator based on Schedule 1 part 2 in calculating liabilities. One is available here.

Paying CIL in Instalments
Enfield Council has a CIL Instalments policy in place and CIL charges will be payable in accordance with this policy. In cases where an Enfield Council charge is £100,000 or less the whole amount will be payable within 60 days of the commencement of the development. Where an Enfield Council CIL charge is £100,001 or more, the amount will be payable in two instalments. Should this be the case and the 1st instalment is not paid by the due date, or there is a non compliance issue, then the full balance will become due immediately.  The payment of CIL in instalments should be taken into account in any viability assessments, as this will assist with cash flow.

Phased Development
For cases where a development which has been permitted in phases, each phase is treated as separate development for the purposes of CIL, and each phase should be entered into a separate calculator. The phasing of payments should be taken into account in any viability assessments, as this will assist with cash flow. A CIL phasing plan should also be agreed as part of the planning permission.

Relief and Exemption from CIL
A number of reliefs and exemptions apply relating to Social Housing, Charities and Self Build.   This must be applied for after a CIL liability Notice has been issued and prior to commencement, otherwise any relief/exemptions could be lost.   There are also conditions of relief/exemptions which includes clawback and disqualifying events over a period of years post completion.

CIL Liability
The initial CIL assessment will be done with the planning application and should be linked to the planning decision.

Formal determination of the CIL liability will be made by Enfield Council when a Liability Notice is issued after a planning permission is granted. Please note that the CIL charges produced by the calculator may be subject to change and may differ to the final calculation of CIL liability.

The final calculation of the CIL chargeable amount will be based on the net gross internal area (GIA) floorspace figures proposed as part of the approved development, and will depend on the following:
- When was the last lawful use of existing buildings?
- Is the floorspace of existing buildings to be demolished or retained eligible for deduction from the CIL chargeable amount?
- Is the development eligible for relief or exemption from CIL?
- Has indexation been applied?
- Have any surcharges or late payment interest been applied?
