Community Infrastructure Levy (CIL)

CIL is a charge that is levied on certain types of development in Brighton and Hove from 05 October 2020. Most new development which creates net additional floor space of 100 square metres or more, or creates a new dwelling, is potentially liable for the levy. The rates charged are published in the Council’s charging schedule in the technical guidance.
 
The Council uses CIL to help deliver the infrastructure needed to support development in the city.
 
Note: CIL payment is triggered by the commencement of development for a planning permission that is CIL liable. Payments may be made in instalments in accordance with the Council’s adopted instalment policy.

 
Section 106 (S106)

Planning obligations under section 106 of the Town and Country Planning Act 1990, commonly known as S106 agreements, make a development proposal acceptable in planning terms that would not be acceptable otherwise. These planning obligations are typically split between two categories: financial obligations (also known as developer contributions) and non-financial obligations.

The data available covers the details of section 106 agreements from 1 January 1980 to now. Section 106 agreements that have expired will be removed from the public facing module but can be found on the Council’s planning register.

Note: This also includes Section 106 legal agreements for both Brighton Borough Council and Hove Borough Council before Brighton and Hove merged into a unitary authority in 1997 and was granted City status in 2001.
